Terms and Conditions for the FuelRod Affiliate Program:

1. Introduction:
Welcome to the FuelRod Affiliate Program (the "Program"). By signing up for the Program, you agree to these terms and conditions (the "Agreement"). This Agreement is between you ("Affiliate") and Tricopian Inc. dba FuelRod ("FuelRod"), and governs your participation in the Program.

2. Program Description:
The Program allows Affiliate to promote FuelRod products and earn commissions on sales generated through Affiliate’s unique referral link. Affiliate will receive a commission on all sales generated through Affiliate’s referral link.

3. Enrollment in The Program
The purpose of the Program is to promote the sale of products offered on our Website.
To begin the enrollment process, you must submit an application through the Program Registration Page on our Website. When you provide information during the registration process, you agree to provide only true, accurate, current and complete information and to update it as necessary to maintain its truth and accuracy. We will evaluate your application and notify you of your acceptance or rejection. We may reject your application for any reason in our sole discretion. We have the right, in our sole discretion, to monitor your website at any time to determine if you are in compliance with the terms of this Agreement. If we reject your application, you are welcome to reapply to the Program at any time for our reconsideration.

4. Affiliate Representations and Warranties:
As an Affiliate, you represent and warrant that you will comply with all applicable laws and regulations, and that you will not engage in any illegal or unethical behavior in connection with your participation in the Program. You agree to indemnify FuelRod against any damages or liabilities arising from your actions.

5. Confidentiality:
As an Affiliate, you agree to maintain the confidentiality of all non-public information related to the Program, including customer data, commission rates, and marketing materials. You are prohibited from disclosing such information to any third party without the prior written consent of FuelRod.

6. Use of Trademarks and Intellectual Property:
As an Affiliate, you may use FuelRod's trademarks, logos, and other intellectual property solely for the purpose of promoting FuelRod products through the Program. You may not use FuelRod's intellectual property in any other way without the prior written consent of FuelRod.

7. Termination for Breach:
FuelRod may terminate this Agreement immediately for any breach of this Agreement by Affiliate. In addition, FuelRod may pursue any and all legal remedies available against Affiliate for any damages or losses resulting from the breach.

8. Arbitration:
Any dispute arising from this Agreement will be resolved through binding arbitration, in accordance with the rules of the American Arbitration Association.

9. Earning Affiliate Commissions
We may pay affiliates based on a percentage of sales, a flat rate, or a tiered commission structure. The payment method and percentage is subject to change from time to time, in our sole discretion. Certain affiliates may receive offers to be paid under different commission structures as we may determine from time to time. If a product that generated commissions is returned by the customer, we will deduct the corresponding commission from your next commission payment. All commission-related data under the Program is collected, calculated and managed by Refersion, our affiliate marketing platform, and its data will be the only valid basis used for determining commissions.

10. Length of Cookie Purchase Period
Our Program uses a thirty (30) day cookie purchase period on our website and a fourteen (14) day cookie purchase period on Amazon. This means that if a visitor to your website clicks through a Program Link to our Website, you will be eligible for commissions related to purchases made by your visitor within thirty (30) days of its click on the Program Link on your website. We will pay commissions to only one affiliate for purchases associated with a given cookie. To the extent multiple affiliates request payments, Refersion shall determine which affiliate to pay. Its decision shall be final and binding. We may change the length of our cookie period from time to time.

11. Commission Payouts:
Commissions will be paid out on a monthly basis, via PayPal after the 30 day conversion approval process by Amazon and Refersion. Commissions will be paid on all sales generated through Affiliate’s referral link, less any refunds or chargebacks. FuelRod reserves the right to withhold commissions for any sales that are deemed to be fraudulent or invalid.

12. Modification:
FuelRod reserves the right to modify this Agreement at any time, in its sole discretion. Any such modifications will be effective immediately upon posting on the FuelRod website. Affiliate is responsible for regularly reviewing the terms and conditions of this Agreement to ensure compliance.

13. Limitation of Liability:
FuelRod will not be liable for any indirect, incidental, or consequential damages arising from Affiliate’s participation in the Program. FuelRod's total liability to Affiliate under this Agreement will not exceed the total commissions paid to you under the Program.

14. Governing Law:
This Agreement will be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law.

15. Entire Agreement:
This Agreement and the “Affiliate Sign-Up Form” constitute the entire agreement between the parties with respect to the Program and supersedes all prior or contemporaneous agreements, understandings, and negotiations, whether written or oral.

By signing up for the Program, you acknowledge that you have read and agree to be bound by these terms and conditions. If you do not agree to these terms and conditions, you should not sign up for the Program.

FuelRod Affiliate Program Privacy Policy:

Tricopian Inc. dba FuelRod ("FuelRod") respects your privacy and is committed to protecting your personal information.
